 In modern times, criminal offenses are established by statutes. Statutes and sometimes sentencing guidelines detail the punishment for each crime. Rules of criminal procedure govern criminal trial and pre-trial proceedings. These statutes, guidelines, and procedural rules must comply with the U.S. Constitution as well as the applicable state Constitution. There are numerous cases interpreting and deciding whether criminal statutes, guidelines, and rules are constitutional, as well as cases addressing other criminal law issues.
